1.Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Datasigma Technologies LLC ("Datasigma," "we," "our," or "us") governing your access to and use of our website, dashboard, data, API, and related services (collectively, the "Services").
By creating an account or using our Services, you agree to be bound by these Terms. If you are using the Services on behalf of a company, you represent that you have authority to bind that company. If you do not agree to these Terms, you must not access or use our Services.
2.Description of Services
Datasigma provides a B2B contact data platform built from publicly available web sources. Our Services include:
- Search across our database of business contacts and companies, with filters for title, seniority, location, industry, company size, and more
- Contact reveals — delivery of a contact's email address and/or phone number, together with a citation to the public source URL where the information was found
- Real-time email validation of revealed contacts
- CSV exports of contacts matching your searches or selections
- Bulk domain lists for including or excluding companies from searches
- API access, available on eligible subscription plans
3.Accounts
To use the Services you must create an account. You agree to:
- Provide accurate, current, and complete information, including a valid work email address
- Keep your login credentials secure and confidential
- Be responsible for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
Accounts are for a single user unless you are on a team plan. We reserve the right to suspend or disable any account that we reasonably believe violates these Terms, including accounts created to repeatedly claim free credits.
4.Credits, Plans, and Payment
Credits. Access to contact data is metered in credits. One (1) credit is charged when we deliver an email address and/or phone number for a contact, whether through an individual reveal or an export. Once revealed, a contact remains accessible to your account at no additional cost. Contacts for which we deliver no email or phone number are not charged.
Automatic credit refunds. If a revealed email address is determined by our validation to be undeliverable and no phone number was delivered for that contact, the credit is automatically returned to your balance. Credits reserved for an export that fails, or that exceeds the number of contacts actually delivered, are likewise returned automatically.
Free credits. New accounts receive a one-time allocation of free credits. Free credits carry no cash value, may not be transferred, and may be revoked in cases of abuse.
Subscriptions. Paid plans are billed in advance on a monthly or annual basis and include a monthly credit allowance. Unless cancelled, subscriptions renew automatically at the end of each billing period. We may change plan pricing with reasonable prior notice; changes take effect from your next billing period.
Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; until then you retain access to the Services and your remaining credits. As set out in our Refund Policy, payments are non-refundable because contact data is delivered instantly and cannot be returned.
5.Acceptable Use
The Services are designed for legitimate business prospecting, recruiting, research, and CRM enrichment. You agree not to use the Services or any data obtained from them to:
- Violate any applicable law or regulation, including privacy, data protection, and anti-spam laws (GDPR, CAN-SPAM, PECR, CASL, and equivalents)
- Send communications that fail to comply with applicable outreach requirements, including identification and opt-out obligations
- Resell, redistribute, sublicense, publish, or otherwise commercially exploit data obtained from the platform in any way — the data may only be used for your own internal sales purposes
- Build, train, enrich, or improve a competing data product or service
- Harass, threaten, or harm any individual, or use the data for any purpose unrelated to business communication
- Access the Services by automated means (scraping, bulk crawling) except through the API as expressly permitted on your plan
- Circumvent credit metering, rate limits, plan limits, or security features, including by creating multiple accounts
- Share one account across multiple users outside a team plan
6.Data and Intellectual Property
The Services, including our database, software, and content, are owned by Datasigma and protected by intellectual property laws. Subject to these Terms and your plan limits, we grant you a limited, non-exclusive, non-transferable license to use data you reveal or export solely for your own internal sales and business-development purposes — prospecting, recruiting, research, and CRM enrichment within your organization.
No resale or commercial redistribution. You may not resell, license, rent, trade, publish, or otherwise make the data commercially available to any third party, in whole or in part, in any form — including as datasets, lead lists, enrichment feeds, lookup services, or as part of any product or service you offer to others. The data is for your internal use only.
You may not:
- Reproduce, distribute, or publicly disclose our data except as needed for your own business communications
- Remove or obscure proprietary notices
- Transfer your subscription or revealed data to a third party as a dataset
- Use the Services to create a derivative database
Our data is compiled from publicly available sources, and each contact record includes a citation to the source URL where the information was found. Source pages remain the property of their respective owners.
7.Data Accuracy
We verify email addresses before they enter our database and validate them again in real time upon reveal. Nevertheless, business contact information changes constantly, and we cannot guarantee that every record is accurate, current, or deliverable at all times. The automatic credit-refund mechanism described in Section 4 is your remedy for undeliverable emails.
We may impose reasonable limits on searches, reveals, exports, and API usage to protect system stability and prevent abuse.
8.Privacy
Our processing of personal data — both yours as an account holder and that contained in our database — is described in our Privacy Policy. We process publicly available business contact information, honor removal requests from data subjects, and expect you to honor opt-out and erasure requests you receive in connection with your own use of the data.
9.Disclaimer of Warranties
We do not warrant that the Services will be uninterrupted, error-free, or secure, that defects will be corrected, or that any particular contact record will be accurate or deliverable.
10.Limitation of Liability
Our total aggregate liability for all claims arising out of or relating to the Services shall not exceed the amounts you paid to Datasigma in the twelve (12) months preceding the event giving rise to the claim.
11.Indemnification
You agree to defend, indemnify, and hold harmless Datasigma and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from your use of the Services, your outreach or other use of data obtained through the Services, or your violation of these Terms or of any law or third-party right.
12.Term and Termination
These Terms remain in effect while you use the Services. We may suspend or terminate your access immediately if you breach these Terms, including the Acceptable Use provisions. Upon termination, your right to access the Services and any unused credits ends; provisions that by their nature should survive (including Sections 6, 9, 10, and 11) will survive.
13.Changes to These Terms
We may update these Terms from time to time. We will provide reasonable notice of material changes — for example by email or an in-product notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
14.Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Datasigma Technologies LLC is registered, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.
