1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and DataSigma ("we," "our," or "us") governing your access to and use of our website, products, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

DataSigma provides advertising intelligence and data services that allow users to access information about companies advertising on various platforms. Our Services include but are not limited to:

  • Access to datasets of advertisers and their advertising activities
  • Search and filtering capabilities for advertiser information
  • Analytics and reporting tools related to advertising data
  • API access for integration with other systems (where applicable)

3. User Accounts

To access certain features of our Services, you may need to create an account. When you create an account, you agree to:

  • Maintain and promptly update your account information

4. Subscription and Payment Terms

Our Services and their contents, features, and functionality are owned by DataSigma and are protected by copyright, trademark, and other intellectual property laws.

You may access and use the content and data provided through our Services only as permitted under these Terms. You may not:

  • Reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any of our content except as expressly permitted
  • Remove any copyright, trademark, or other proprietary notices from any content
  • Transfer your subscription or access rights to another person or entity
  • Resell, lease, or otherwise commercially exploit our data or Services without explicit permission

7. Data Usage and Limitations

Our Services provide access to data about advertisers and their activities. You acknowledge and agree that:

  • The data provided is for informational purposes only and may not be completely accurate or up-to-date
  • You will use the data in compliance with all applicable laws, including privacy and data protection laws
  • You will not use the data for unsolicited communications or in a manner that would violate individuals' privacy rights
  • You may only use the data for your internal business purposes, unless explicitly permitted otherwise
  • We may impose reasonable limitations on data access, downloads, and API usage to ensure system stability

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Services will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Services are free of viruses or other harmful components
  • The results of using the Services will meet your requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DATASIGMA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims shall not exceed the amounts paid by you to DataSigma during the twelve (12) months preceding the date on which the claim arose.

10. Indemnification

You agree to defend, indemnify, and hold harmless DataSigma and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

  • Your use of and access to the Services
  • Your violation of these Terms
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right

11. Term and Termination

These Terms shall remain in full force and effect while you use the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide reasonable notice of any material changes. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
